& Beautiful reserves the right to update or modify its terms of use
at any time without prior notice. Your use of the brightbeautiful.com
website following any such change constitutes your agreement to be bound
by the revised terms. For this reason, we encourage you to review the
terms of use whenever you visit this website.

Bright
& Beautiful will do all that is reasonably possible to ensure that
availability of this website will be uninterrupted and error free but
is unable to guarantee these matters. Your access to this website may
from time to time be suspended or restricted to allow for the introduction
of new facilities or services or for repairs or maintenance.

to cause the website or access to it to be interrupted, damaged or impaired
in any way. You must use this website for lawful purposes only and must

& Beautiful grants you a limited licence to access and make personal

6. Your Account
If
you use this website, you are responsible for maintaining the confidentiality
of your account and for restricting access to your computer to prevent
unauthorised access to your account. You accept responsibility for all
activities that occur under your account. You must ensure the details
you provide us with are correct and complete and inform Bright & Beautiful
immediately of any changes to the information that you provided when registering.
Bright
& Beautiful reserves the right to refuse access to its website, terminate
accounts, remove or edit content or cancel orders at its discretion. Any
cancelled order will be without charge to you.
7. Our Contract
Subject
to clause 6, when you place an order to purchase a product from Bright
& Beautiful we will send you an email confirming receipt of your order
and containing its details. Your order represents an offer to us to purchase
a product which is accepted by us when we send email confirmation to you
that we dispatched that product. Acceptance will be completed at the time
we send the confirmation email. Any product on the same order that is
not the subject of a confirmation email will not form part of that contract.
8. Delivery
Bright
& Beautiful delivers your order throughout Australia in exquisite
and colourful packaging which has become a signature of our business.
We will use either Australia Post or a Courier Service depending on the
size of the articles ordered so as to utilise the most cost effective
solution for our customers. Your delivery charge is based on size and
weight ranging from a minimum of $1.50 per item to a maximum of $6.00
per item for large heavy items.
Please note that Bright & Beautiful cannot deliver to P.O. Boxes.

9. Product Information
The
prices displayed on this site are quoted in Australian Dollars and are
valid and effective only in Australia. All merchandise has been included
in good faith on the basis that the goods as described will be available.
Failure by a supplier to deliver in accordance with description or at
all, or other causes beyond our control, may result in some lines being
unavailable. Prices quoted and bonus offers are applicable only while
stocks last. Percentage savings shown are off supplier recommended retail
prices. Bright & Beautiful reserves the right to correct errors, omissions
and misprints. Pictures are for illustrative purposes only – not
all patterns and options shown may be available. Not all available patterns
and options may be shown. Unless otherwise stated, accessories are not
included.
10. Despatch
Goods
will be dispatched from our warehouse at Yatala, Queensland within forty
eight (48) hours from receipt of the order (if accepted). Please note
that our office hours are 8 am to 5 pm Monday to Friday. Orders received
outside our working hours will be deemed received on the next working
day. For example: an order received at 8pm Tuesday will leave our warehouse
no later than 8am Friday.
Your
order will be delivered on working days between 8.00am and 6.00pm. To
ensure a safe and prompt delivery, we recommend delivery to your work
address if you’re not going to be home during normal working hours.
Your package may require a signature. We’ll need your daytime phone
number so we can contact you if there are any problems with delivery.
If you are not home when we attempt to deliver your parcel a card will
be placed in your mail box requesting that you contact the courier company
or Australia post to arrange a more suitable time for them to drop the
parcel.
Please
note:
Bright
& Beautiful will make every endeavour to ensure your parcel is delivered
on time. However, occasionally some delays may occur for which we have
no control. Bright & Beautiful will not be liable for any expenses
or damages incurred due to delayed delivery
11.
International Orders
Bright
& Beautiful will gladly accept international orders and arrange international
deliveries. If you specifically wish a product to be sent overseas you
can email, fax or post the details and we will contact you regarding final
costing and shipping and delivery timing. Please note that additional
security requirements are needed for international customers wishing to
pay by credit cards.
12. Return Exchange & Refund Policy
At
Bright & Beautiful your complete satisfaction is important to us.
Any faulty, damaged or unsatisfactory item can be returned within twenty
one (21) days of receipt of shipment for a full refund on the cost of
the goods (excluding shipping). If you are not satisfied with your purchase
please follow this procedure;

Contact
Bright & Beautiful Customer Service on 07 3287 3973. A customer
service representative will evaluate your return request, record
all the necessary product return information and issue you with
a Return Authorisation Number. The Customer Service Representative
will then provide you with an address to send or deliver your return.
Please note: You must obtain an R.A. number WITHIN SEVEN (7) DAYS
OF DELIVERY to ensure that you are eligible for a replacement or
a refund. |

Send
your item to the return address provided. The return must be received
by Bright & Beautiful within fourteen (14) days of the RA number
being issued. |

As
soon as the return has been received, a replacement product will
be shipped or refund issued (excluding shipping). Replacement product
or refund will only be shipped or issued after the faulty, damaged
or unsatisfactory product has been received by Bright & Beautiful.
Please
note:
Unsatisfactory
product must be returned in the original packaging and with tags
and be in a saleable condition. Partially used products will not
be credited. Similarly, full credit is subject to a quality control
inspection carried out.
We
have done our best to display as accurately as possible the colours
and detail of the products shown on this Website. However, because
the colours you see will depend on a number of factors beyond
our control, including your monitor, we cannot guarantee that
your monitor’s display of any colour will be accurate.

13. Children
Bright
& Beautiful does not sell products for purchase by children although
we may sell children’s products for purchase by adults. If you are
under 18 years of age, you may use this website only with the involvement
of a parent or legal guardian.
14. Electronic Communications
When
you visit Bright & Beautiful or send emails to us you communicate
with us electronically. We will similarly communicate with you by email.
For contractual purposes, you consent to receive communications from us
electronically and you agree that all communications that we provide to
you electronically will satisfy any legal requirements that such communications
be in writing.
15. Events beyond our reasonable control
Bright
& Beautiful will not be responsible for any delay or failure to comply
with its obligations under these terms of use if the delay or failure
arises from any cause which is beyond its reasonable control. This condition
does not affect your statutory rights or in any way limit any other provision
of the terms of use.
16. Indemnify
You
agree to indemnify and hold Bright & Beautiful harmless from and against
any and all claims, damages, costs and expenses, including legal fees,
arising from or related to your use of this website.
17. Waiver
If
you breach these conditions and we take no action, we will still be entitled
to use our rights and remedies in any other situation where you breach
these conditions.
18. Governing Law
These
conditions are governed by and construed in accordance with the laws of
the State of Queensland in the Commonwealth of Australia. You agree to
submit to the non-exclusive jurisdiction of such Courts.
19. Place of payment
Subject
to any written agreement to the contrary, all payments will be made to
Bright & Beautiful at the address stated at the commencement of these
terms of use.

This
site and all its contents are provided on an "as is" basis without
warranties of any kind, either express or implied, including without limitation
(and to the extent permitted at law) warranties as to title or implied
warranties of merchantability or fitness for a particular purpose. You
acknowledge, by your use of this site, that such use is at your sole risk,
that you assume full responsibility for all costs associated with all
necessary servicing or repairs of any equipment you use in connection
with your use of our site, and that Bright & Beautiful shall not be
liable for damages of any kind related to your use of this site.

and we do not record credit card information.
